Prosecutors ask jury to convict Thompson for ‘brutal’ attack

YAKIMA – Jurors were asked Monday to decide whether Spokane Police Officer Karl F. Thompson Jr. is a “rogue cop” and liar who hid behind a departmental coverup, or a “hero” who was simply protecting the public when he beat Otto Zehm with a baton 13 times and shocked him with a Taser.
Deliberations in the excessive force trial began on what would have been Zehm’s 42nd birthday. He died without regaining consciousness following a violent March 18, 2006, police confrontation inside a Spokane convenience store after being mistakenly identified as a suspect in a possible theft.
“The defendant abused the power entrusted to him with a brutal, unprovoked attack that left Mr. Zehm helpless and beaten in the center aisle. Then he counted on his department to whitewash the incident … and it did,” federal prosecutor Victor Boutros said in closing arguments Monday. “This is a tragic and terrible story. It’s not over yet. The defendant doesn’t get to abuse Mr. Zehm with impunity and then cover it up.
“You get the final word,” Boutros continued. “And the final word is guilty.”
But defense attorney Carl Oreskovich described Thompson as a Vietnam War hero, and high-school dropout turned college graduate who had his reputation soiled by over-zealous federal prosecutors seeking to convict him for legitimate law enforcement actions.
“This is not a man who creates a web of lies. This is an honorable man,” Oreskovich said of his client during closing arguments Monday. ”This is not a rogue, tough-guy cop … who runs up on someone and clubs them with a baton. He’s not a liar, not a Tombstone-courage cowboy but someone who was known as a thinker with a good demeanor who had the respect and admiration of probably the toughest critics: the people that you work with.”
The attorneys delivered their closing statements as the trial entered its fourth week. Thompson is charged with using unreasonable force and lying to investigators following the confrontation with Zehm, who was at the time a 36-year-old part-time janitor with paranoid schizophrenia who liked to meet with friends for guitar jam sessions.
Earlier in the day, Assistant U.S. Attorney Timothy Durkin persuaded U.S. District Court Judge Fred Van Sickle to include a jury instruction that spells out that a citizen can resist unlawful force.
“Respectfully, the failure to advise the theory in this case that Mr. Zehm had a right to resist unreasonably excessive, injurious and lethal force … will result in a manifest injustice,” Durkin said. “The failure to inform the jury that Mr. Zehm had the right to resist … will force the jury to believe that the defendant was the only one authorized to use force.”
Boutros at one point invoked the comic book hero Spiderman while arguing that jurors should find Thompson’s version of the encounter absurd.
Boutros said Thompson and several Spokane Police witnesses previously testified that only experienced police officers can see warning signs of violence that regular citizens don’t, such as Zehm’s eyes, facial expression and “invisible” tensing of muscles under a heavy leather jacket.
“It’s almost like Spidy sense,” Boutros said. “You know how Spider-Man has a glint in his eye and he knows something bad is about to happen. It can’t be impeached by citizen eye witnesses or video. Only (Thompson) could have seen those things.”
Boutros said Thompson knew he could get away with his unjustified beating of Zehm because he knew Detective Terry Ferguson “is going to whitewash this for him and she does. Not only does she say don’t prosecute but she says there is no evidence of excessive force. None.
“What he didn’t consider is another review” by the FBI that included comparing witness statements and Thompson’s version of events to the video, Boutros continued.
Thompson’s March 22, 2006, statement includes several allegations of Zehm’s actions, none of which were shown on the video, he said.
“Then he takes the stand and gives you a third version. ‘I got some things out of order. All the stuff you can’t see? That’s where my justifications are’” he said, speaking for Thompson. “It’s all hidden behind the shelf.”
But Oreskovich countered that federal prosectors had failed to prove the case because Thompson can only be judged by what he perceived at the time, and Thompson believed that Zehm – who was retreating – was about to assault him.
“The government has not established one iota – not one shred of evidence that this man acted with a bad or evil purpose,” Oreskovich said. “If those were my children standing at the counter (of the Zip Trip), if someone had taken money, ran away and appeared to be high … what I want is this man to go in there. That’s what we ask of (officers). Isn’t that what we have them for, to respond to the risk and to have courage?
“He does the job we demand,” Oreskovich continued. “Now he gets accused of a crime and accused of creating a web of lies.”
Boutros challenged Oreskovich’s notion that after five-and-a-half years that Thompson was somehow the victim.
“Don’t forget what happened to Mr. Zehm,” Boutros told the jury. “Don’t forget the terror and panic Mr. Zehm suffered with no way to stop the acts from continuing. His last words were, ‘All I wanted was a Snickers.’ We are asking you to let the defendant know that no one is above the law.”

On the day Otto Zehm would have turned 42, a federal prosecutor asked a jury today to convict Spokane Police Officer Karl F. Thompson Jr. of using excessive force and hiding behind a department-wide cover-up to justify his actions.
Victor Boutros, a trial attorney with the U.S. Department of Justice, told jurors in his closing statement that Thompson kept changing his story because evidence continually showed he had no justification for striking Zehm with a baton on March 18, 2006, during a confrontation from which Zehm later died.

Thompson faces the felony charges of using unreasonable force and lying to investigators following the confrontation with Zehm, who at the time was a 36-year-old part-time janitor who had paranoid schizophrenia.
The jury is expected to start its deliberations immediately after Oreskovich and Boutros complete their arguments.

After including that instruction in the final draft, Boutros spoke for 90 minutes and even used a reference to Spider-Man about how Thompson continually changed his story to make his actions look justified.

I thought I heard a collective “gulp” by the coppers over that one…not sure…but it does go against their Just Us theory of use of force.
Prosecution did not seem to prove their case in my humble opinion from the twitter posts that have outlined testimony.
The U.S. Attorney’s appear to have made an effective closing argument.
It will be hard for defense counsel to overcome the fact that that SPD creates these mystifications about how only they have the omnipotent observation skills which justify everything they do to us local civilians, and that we don’t understand that.
I am very pleasantly surprised that Van Sickle went along with anything that does not stack the deck in favor of law enforcement. A very pleasant surprise indeed.
This still has a chance of turning out in a way that empowers us civilians in accordance with legal principles.
Of course we need to wait and see what Thompsons sentence is after he’s convicted before we make any assertions about justice being served.
We all need to bear in mind that a conviction and credible sentencing of Karl Thompson, although a good thing for us civilians, does not mean we should ignore the need for independent civilian oversight of local law enforcement agencies.

This trial has been the BIGGEST waste of tax-payers money. their is only ONE just verdict in this case and its NOT GUILTY, and Karl Thompson needs to sue the prsisecuters for millions for false and Malicious prosecution and make them PAY for what they have put this poor poor man thru for just doing his job. A disturbing flyer found at ‘Occupy Phoenix’ says cop killers are the ‘good guys’
PHOENIX, Ariz. — A flyer surfaced at ‘Occupy Phoenix’ that encourages the shooting of police officers, asking “When should you shoot a cop?”
A sheriff’s deputy found the disturbing flyer at the Cesar Chavez Plaza and reported it to the Arizona Counter Terrorism Information Center, according to KPHO. Officials informed all local law enforcement agencies, who are investigating.
“Our investigation has begun, we’re trying to determine who distributed those flyers. Who authored those,” Bart Graves of the Arizona Department of Public Safety said.
Two ‘Occupy’ protesters claimed their group was not responsible, and they told TV reporters that the message doesn’t help the movement’s image.
The flyer chillingly advocates for cop killers and elevates them to almost hero status, Conservative Byte reported.
“The next time you hear of a police officer being killed “’in the line of duty,’ take a moment to consider the very real possibility that maybe in that case, the ‘law enforcer’ was the bad guy and the ‘cop killer’ was the good guy,” the flyer reportedly read.

The cause of death as the defense expert they didn’t call was positional asphyxia compounded by the officers sitting on him in a prone position without turning him on his side. Further his breathing was severely restricted by the application of the mask. This was a non sanctioned/approved usage of this mask.
Bottom line this was a wrongful death. Under state law this could have been a negligent homicide/manslaughter. The state charge would have been easier to prove vs. the federal charge of violating his civil rights. The federal charge requires willfulness. Mistakes, bad practice/judgments and or ignorance. All that is needed for negligent homicide is to show recklessness. It’s clear from all the expert testimony what Ofc. Thompson did was outside of his scope and training.
Right on Ed. The mental defective in this case happens to be a cop.
I cant wait till the Mayors budget takes a hit with the Otto Zehm civil trial awards.
Actually, anotherp, the payout (if there is one) would come from the City’s insurance policy; not the general budget…I believe.
Most probably the insurance only covers any damage awards above a large deductible…and the insurance company may very well attempt to avoid paying anything at all, depending upon the various trial outcomes. Having insurance doesn’t provide protection for wilful negligence. I suspect the general fund budget is likely to take a huge hit. More court battles on the way, to be sure.
The Jury should have been told Otto was innocent at the time of the vicious beating. Lets hope they come back with a guilty verdict.
I would hope that anything but a guilty verdict would spark peaceful protests on the doorsteps of Spokane’s courthouse. I don’t condone violence or civil unrest. Letting our elected officials know how we feel is necessary and may spark change.
Limiting the power of the lolli-pop guild is becoming one of the most important issues facing Spokane. Firing,charging and prosecuting the corrupt and heavy handed police will bring needed change. The Para-military training given to the police should stop immediately also. This directly contributes to the heavy handed mentallity currently rampant in the departments. Thompson faces up to 20 years in federal prison and a maximum $250,000 fine if convicted for lying to investigators and up to 10 years and the same maximum fine for the “unreasonable use of force” charge.

My understanding is the city has a $1M cap on their liability insurance in cases like this, over that, assuming the insurance company agrees to pay the $1M, city taxpayers are on the hook. If we had real justice, the city would bill back the RPS owners.

I read that the house is worth $675,000.00, wifey got it in the deevorce and was supposed to sell it, but the market crashed and she pulled it off the market. And that ex-wifey, which he still lives with rent free, got 1/2 of his retirement in the deevorce settlement; effectively shielding 1/2 of his retirement pay from a civil suit.

This is a crucial piece that is about time [of course it took a Federal Prosecutor to emphasize and put it in the record—even if the Justice didn’t want to allow it he was Constitutionally bound to do so] the average US Citizen recognizes as a inalienable right.

I don’t give a rip what Garzap or whatever says, but I don’t want others to have the mistaken belief that “most schizophrenics have been abused as children”.
That is simply not true. Schizophrenia is a thought disorder that rarely presents itself until after puberty. Mothers, abuse, fathers, mosquitoes, vaccines, and Jupiter aligning with Mars do not cause it either. It is caused physiologically by a chemical imbalance in the brain, but the causes of that are the threads of numerous research trials.
Otto has been variously described as “mentally ill, challenged, disabled” “developmentally disabled/delayed/” “retarded”. From these reports, the programs he was enrolled in and from talking to a person who used to supervise him, it sounds as if he was developmentally disabled and also had a mental illness, perhaps schizophrenia. Sometimes these things are tricky and almost always as the person ages behavior mellows (just as in the general population). However, he had been developmentally disabled since at least childhood and probably since birth. (i.e. mentally retarded—still the clinical name but no longer PC.) This is what most people would have noticed about him initially.
It would have made no difference what his disability/illness/problem was since he provided precious little input into the discussion with Karl.

After 7 1/2 hours on this site just yesterday, I wonder if your job is to be on here causing people to argue their point. Because a person working 70+ hours a week don’t have time to spend 7 1/2 hours in one day blogging.
